Estate Administration

Estate Administration is the process administering the affairs of a deceased person either as set out in their Will or under the Rules of Intestacy (if the deceased died without a Will).

The steps involved in estate administration include:

  • Locating the deceased's last valid Will;
  • Identifying and securing the deceased’s assets, such as, their home;
  • Paying the deceased's debts;
  • Dealing with any challenges or disputes; and
  • Distributing the estates to the beneficiaries.


Probate is the process of proving a Will is valid. To obtain a "Grant of Probate" the executor needs to apply to the Supreme Court.

It is not always necessary to obtain a Grant of Probate to administer an Estate. Whether a Grant of Probate is required or not, often depends on the type of assets of the deceased.
